This indenture made this 18th day of September 1872 between D. A. Langhorne and W. H. Langhorne Trustees for J. A. Langhorne and Margaret K. Langhorne his wife, John M. Payne and Elizabeth A. Payne his wife, formerly Elizabeth A. Langhorne, Maurice D. Langhorne, William M. Ellis and Margaret K. Ellis his wife, formerly Margaret K. Langhorne and John W. Langhorne of the one part, and the Atlantic, Mississippi and Ohio Rail Road Company of the other part, acting for and in behalf of the Virginia and Tennessee Rail Road Company, Whereas sometime in the year 1869, C. A. Calhoun representing himself and the other owners of the property known as Alleghany Springs, for and on behalf of said owners and other persons residing near and about Shawsville in Montgomery County, Va. did represent to the Virginia and Tennassee R. Rd. Co. that they desired for the public benefit but more especially for their own account, that the said Rail Road Co. should establish at such point - Shawsville - a regular station for the receipt and delivery of passengers and freight, and it was then agreed by the said Rail Road Co. to establish such station on condition that the said Calhoun on behalf of said owners of Alleghany Springs and the owners of the land on which it was proposed to erect a depot building as hereinafter referred to, should deed to the said Rail Road Company with the fee simple, about two (2) acres - more or less - of land at and around the proposed point at which such station was to be established, such deed to condition however that whenever said Rail Road Company should discontinue or abolish such Station that then and in that case, the said lot or land should revert to the owners thereof; and it was further agreed by said Calhoun representing the owners of said Alleghany Springs, that he would erect and at his own proper and exclusive cost construct and complete at such station and upon such ground to be given, a station-house for the accommodation of passengers and freight, in accordance with plans and specifications to be furnished by said Rail Road Company, and it was further agreed that upon the completion of such Station House and the surrender to the said Rail Road Company of the deed aforsaid, which should embrace such Station building, the said Rail Road Company would open and continue to maintain such as a regular station as aforesaid provided however that in making Shawsville a regular Station as aforesaid, that except during the "Springs Season" the regular passenger trains of the Road would not undertake to stop at such Station unless for the delivery of Passengers or unless signalled for the receipt of passengers, and Whereas, since said understanding and agreement with said Calhoun, and under the same he in behalf of the owners of the said Alleghany Springs has constructed a Station building at Shawsville as aforesaid, and said Rail Road Company has opened the same as a regular Station, upon the conditions hereinbefore recited; Now therefore this Indenture witnesseth, that the said parties of the first part for and in consideration of the premises and of the sum of One dollar to them in hand paid by the said party of the second part at and before the sealing and delivery of these presents, the receipt of which is hereby acknowledged, have granted bargained and sold and conveyed, and by these presents do hereby grant bargain and sell and convey unto the said Atlantic, Mississippi and Ohio Rail Road Company and to their successors and assigns forever, with general warranty of title, that lot or parcel of land lying and being in the County of Montgomery at said point on said party of the second part's railway, heretofore known as Shawsville and containing 1 63/100 acres more or less, and bounded as follows: Beginning at point A, on the Southern boundary line of the said Va and Tenn. R. Rd. Co's right of of way, 40 feet in a perpendicular line from a point X in the center of the said Co's main track, 351 feet from the west abutment of an overhead bridge on the said Company's railway east of said station thence in a line parallel to said main track and coincident with said line of right of way limit 596 feet to C, thence in a right line 64 feet to E, a point on the Northern boundary of the old Turnpike Road, thence following said Turnpike Road to B, the intersection of the prolongation of a line drawn from X to A and said Turnpike Road being distant from A some 142 feet all as laid down and described in the plat of said lot or parcel of land which is hereto annexed as part hereof, to have and to hold the said lot or parcel of land together with the building erected thereon and all and whatever appurtenances, easements and privileges. Provided however that whenever the said Rail Road Company party of the second part as aforesaid shall discontinue or abolish such Station, that then and in that case the said lot or parcel of land shall revert to the said parties of the first part. It is to be understood that in making Shawsville or Alleghany Station a regular plece for the receipt and delivery of passengers and freight that except during the "Spring Season" the regular passenger trains of the said party of the second part will not undertake to stop at such station unless for the delivery of passengers or unless signalled for the receipt of passengers in all other respects to be treated as one of the regular Stations on the line of the said Company's Rail Road. Witness the signatures and seals of the respective parties to this Indenture, all on the day and year first above written.
